Resolution by the Connecticut General Assembly upon the Petition of Philip Moses, Esther Freeman, Eli Seymour, and Mary Seymour

Upon the petition of Philip Moses and Hester Frank, both of Derby in New Haven County,1 and Eli Seymour of New Haven in said County and Mary his wife, shewing to this Assembly that they, the said Philip, Hester, and Mary, are the sole proprietors of a piece of land situate at or near Humphreysville in said Derby in quantity about twelve acres, which descended to them from John Howdee, an Indian, late of said Derby, deceased, and is bounded northerly and westerly on land of Colonel David Humphreys, southerly on an old highway and easterly on land of Phebe Stiles, that the petitioners are unable to fence said land, whereby the same has become useless to them and praying that some suitable person may be authorized to sell said land2 and vest the avails in such other estate as may be judged most conducive to the interest of the petitioners as by petition dated the 8th day of May 1810 on file, the facts stated in said petition being proved.

Resolved by this Assembly that Joseph Riggs of said Derby be and he is hereby authorized and empowered under the direction of the Court of Probate for New Haven District to sell said land and to give and execute a proper deed or deeds of conveyance thereof, and to vest the net avails of said land when so sold in such other real estate as shall be approved of by said Court of Probate in such manner that they, the said Philip, Hester, Mary and their representatives, shall hold the estate so purchased in the same proportion as they now own in the land above described.
